Agreement
By downloading, installing, or using Save Tracker ("the App"), you agree to these Terms of Use ("Terms"). If you do not agree, do not use the App. These Terms are between you and InGoal Magazine Inc. ("InGoal," "we," "us," "our") and supplement Apple's standard Licensed Application End User License Agreement (EULA), which also governs your use of the App. In the event of a conflict between these Terms and Apple's EULA, Apple's EULA prevails. You acknowledge that these Terms are between you and InGoal only, and not with Apple. Apple is not responsible for the App or its content, and has no obligation to provide maintenance or support services for the App.
Description of the App
Save Tracker is an iOS app that lets hockey goalie parents track saves, goals, and shots during games. All statistics are manually entered by the user and may contain errors. Game data is intended for personal reference only and should not be treated as official records. Core tracking features work entirely on your device. Optional features — game recap emails and the Pro upgrade — require an internet connection and interaction with our servers.
Eligibility
You must be at least 13 years of age to use the App. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
Your Account and Data
Save Tracker does not require an account or login. All game data is stored locally on your device. Deleting the App, resetting your device, or losing your device may result in permanent loss of stored game data. We cannot recover locally stored data. If you choose to provide an email address for recap reports, you are responsible for providing a valid email address that you own or have permission to use. You agree not to provide email addresses of others for recap sharing without their consent.
In-App Purchases and Subscriptions
Save Tracker offers an optional Pro upgrade available as:
- An annual auto-renewing subscription
- A monthly auto-renewing subscription
- A one-time lifetime purchase — provides access to Pro features for as long as the App is offered in its current form
All purchases are processed by Apple through the App Store. Prices are displayed in the App before purchase and may vary by region. Subscriptions auto-renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. You can manage or cancel subscriptions at any time in your device's Settings → Subscriptions.
Refunds are handled by Apple in accordance with their refund policy. We do not process refunds directly.
Acceptable Use
You agree to use the App only for its intended purpose — personal, non-commercial tracking of goalie game statistics. You agree not to:
- Use the recap email feature to send unsolicited or spam emails, or enter email addresses of recipients without their permission
- Attempt to interfere with, compromise, or abuse our servers or services
- Reverse engineer, decompile, or disassemble the App
- Use the App for any unlawful purpose
We reserve the right to suspend or block access to server features (recap emails) if we reasonably believe you are violating these Terms.
Third-Party Services
Certain features of the App rely on third-party services, including email delivery and subscription management. We are not responsible for the availability, performance, or policies of those services. For details on which services we use, see our Privacy Policy.
Service Availability
Core tracking features work offline and are always available on your device. Server-dependent features (recap emails) require an internet connection and depend on the availability of our servers and third-party services. We make reasonable efforts to maintain service availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue server features at any time with reasonable notice where practicable.
Intellectual Property
The App, including its design, code, graphics, and content, is owned by InGoal Magazine Inc. and protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App on your personal devices in accordance with these Terms and Apple's EULA.
Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free, uninterrupted, or free of harmful components. We make no guarantees regarding the accuracy of any statistics recorded in the App. Game statistics are manually entered by the user, are for personal reference only, and should not be relied upon as official records.
Limitation of Liability
To the maximum extent permitted by applicable law, InGoal Magazine Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of the App, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.
Our total aggregate liability for any claims arising from your use of the App shall not exceed the amount you paid for the App or any in-app purchase in the twelve (12) months preceding the claim, or ten US dollars ($10), whichever is greater.
Indemnification
You agree to indemnify and hold harmless InGoal Magazine Inc., its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the App or violation of these Terms.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date at the top of this page. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
Termination
You may stop using the App at any time by deleting it from your device. We may terminate or suspend your access to server features if you violate these Terms. Upon termination, your right to use the App ceases. Provisions that by their nature should survive termination (including Disclaimer of Warranties, Limitation of Liability, and Indemnification) will survive.
Governing Law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms or the App shall be resolved in the courts of competent jurisdiction located in British Columbia, Canada.
